Keywords: Recognition of Arbitral Awards | New York Convention 1958

Summary:

I – For recognition purposes, the names of the parties must appear in the foreign arbitral award;

II – The fact that the parties’ names are incorrectly spelled or incompletely stated in the award does not prevent its recognition (and enforcement), provided there is no doubt as to the parties’ identity or, if doubts arise, they can be clarified through other means of proof;

III – The requirement of party identification is met by an award that identifies the respondent by its corporate name on page 1 and, on page 2, in the section reserved for party identification, although not mentioning the company’s name, includes its registered office (which, moreover, matches the one indicated in the power of attorney granted by the respondent).
