Summary:

I. An arbitral award may only be annulled by a state court where the appellant establishes one of the grounds expressly set out in Article 46(3) of the Voluntary Arbitration Law.

II. If the appellant alleges a breach of the fundamental principles referred to in Article 30(1) of the Voluntary Arbitration Law, or claims that the arbitral proceedings departed from the parties’ agreement, but fails to demonstrate the existence of such breaches or that they had a decisive impact on the outcome of the award, there are no grounds for annulment.
