Complexity of the case, time consumed, (and other) factors must be considered when fixing the arbitrator’s fees.   

Summary:

  1. When fixing the arbitrators’ fees, it is necessary to consider that this is a proceeding in which issues of high complexity are discussed, involving large amounts of assets and the time to be spent may exceed twelve months.
  2. Therefore, the amount of fees payable must comply with rules of proportionality between the amount paid and the work done.
  3. The fact that the proceedings have not been contested, reasonably allows for a reduction of the tasks required from the members of the Arbitral Tribunal.
