Headline: The submission agreement shall expire, and the arbitral tribunal shall be relieved from its remit if the arbitral award is made after almost two years since the date on which the arbitration proceedings commenced.

 

Summary:

  1. An award rendered by the Arbitral Commission of the Portuguese Professional Football League, after almost two years since the date on which the arbitration proceedings have commenced, shall be set aside unless the parties have agreed on a different time period to issue that award (Art. 19(2) of the Arbitration Act).
  2. If the arbitral award is not made within the time limit set forth in Art. 19(2) of the Arbitration Act, the submission agreement shall expire, pursuant to Art. 4(1)(c) of the Arbitration Act, and the arbitral tribunal shall be relieved from its remit.
  3. This conclusion shall apply even if the dispute falls within the exclusive jurisdiction of the Arbitral Commission of the Portuguese Professional Football League.
