Summary:

For the purpose of Arts. 289 and 389(1)(d) of the Portuguese Code of Civil Procedure, the arbitration proceedings are deemed to be commenced with the preparation for the constitution of the arbitral tribunal, that is, when the request for arbitration is sent to the respondent (Art. 11 of the Law no. 31/86 of 29/08). It is not necessary that such notice is certified.
